Terms of Service

Welcome to Vetty. These Terms of Service ("Terms") govern your access to and use of Vetty, including our websites, applications, and the AI assistant known as "Ash" (together, the "Service"). These Terms are a contract between you and Geno Brown, and they incorporate our Privacy Policy. By accessing or using the Service, you agree to these Terms. Please also read our Privacy Policy, which describes how we collect and use personal information.

I. Who We Are

Vetty is an AI-powered assistant that provides general, informational guidance to help pet owners understand and care for their pets. The Service is operated by Geno Brown ("Vetty," "we," "us," or "our"). You can reach us at help@vetty.org.

II. Account Creation and Access

Minimum age. You must be at least 18 years old, or the age required to consent to use the Service in your location if higher, to use the Service.

Your account. To access certain features, you must create an account. We use a third-party authentication provider (Clerk) to manage sign-in. You agree to provide accurate, current, and complete information, to keep your credentials secure, and to be responsible for all activity that occurs under your account. You may not share your account or credentials with anyone else. Notify us promptly at help@vetty.org if you become aware of any unauthorized use of your account.

Additional terms. Some features may require you to accept additional or supplemental terms. Those terms supplement these Terms for the applicable feature and, in the event of a conflict, govern for that feature.

You may close your account at any time by contacting us at help@vetty.org.

III. Use of the Service

You may access and use the Service only in compliance with these Terms and all applicable laws. You are responsible for all activity under your account. You may not, and may not help anyone else:

• use the Service in any way that violates applicable law or regulation;
• rely on the Service for emergency situations or as a substitute for professional veterinary care or decision-making;
• use the Service, or any output from it, to develop or train a competing product or service, or to develop any artificial intelligence or machine-learning model;
• decompile, reverse engineer, or attempt to extract the source code of the Service, except where this restriction is prohibited by law;
• crawl, scrape, or harvest data from the Service except as we expressly permit;
• access the Service through automated or non-human means except as we expressly permit;
• use the Service to gain unauthorized access to any system, or to deceive, defraud, or mislead any person;
• infringe, misappropriate, or violate the intellectual property, privacy, or other rights of others; or
• introduce malware, spam, or otherwise abuse, disrupt, or interfere with the Service or its protective measures.

IV. Not Veterinary or Medical Advice

A feature referred to as "Vet on Demand," which would connect you with licensed veterinarians, is described on our website as "coming soon" and is not currently available. We make no promise that it will launch, launch by any date, or include any particular functionality. If and when it becomes available, additional or revised terms may apply.

V. Inputs, Outputs, and Materials

Generally. You interact with the Service by submitting information, including messages to Ash and details about you and your pet ("Inputs"). The Service generates responses based on your Inputs ("Outputs"). Inputs and Outputs together are "Materials."

Your rights and responsibilities. As between you and us, you retain any rights you have in your Inputs. You are responsible for your Inputs and represent that you have the rights necessary to submit them and that doing so does not violate these Terms or any law. Subject to your compliance with these Terms, we assign to you whatever rights we may have in the Outputs generated for you.

Reliance on Outputs. Artificial intelligence and large language models are evolving technologies. You acknowledge and agree that Outputs may be incomplete, inaccurate, outdated, or wrong even when they appear detailed or confident; that Ash may not recognize every emergency or serious condition; that the Service may not reflect correct, current, or complete information; and that you should not rely on any Output without independently confirming it with a licensed veterinarian. You should never rely on the Service as the sole basis for a decision about your pet's health.

Our use of Materials. We may use Materials to provide, maintain, and improve the Service. To operate the Service, your Inputs and Outputs may be processed by third-party AI providers, as described in our Privacy Policy. We do not use your Materials to train AI models.

VI. Feedback

We welcome feedback, including ideas, suggestions, and ratings of Outputs (such as a thumbs up or thumbs down). If you rate an Output, we may store the related conversation as part of your feedback. You have no obligation to provide feedback, but if you do, you agree that we may use it without restriction or obligation to you.

VII. Fees and Payment

The Service is currently provided free of charge. We may introduce paid features in the future. If we do, we will present the applicable fees and payment terms to you before you incur any charge, and your use of those features will be subject to those additional terms.

VIII. Third-Party Services and Links

The Service may rely on, link to, or integrate with third-party products and services, including authentication, hosting, and AI providers ("Third-Party Services"). We do not control Third-Party Services and are not responsible for them. Your use of any Third-Party Service is at your own risk and subject to that third party's own terms and policies, including its privacy policy.

IX. Software and Updates

The Service may include software, including applications we provide ("Software"). We may update the Software automatically or manually, with or without notice. The Software may include open-source components, and where open-source license terms conflict with these Terms, those license terms govern for that component to the extent of the conflict.

X. Ownership of the Service

The Service — including Ash, the Vetty name and logo, software, text, and design, but excluding your Inputs — is owned by Geno Brown and its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms. Other than the rights expressly granted here, these Terms do not grant you any right, title, or interest in the Service.

XI. Disclaimer of Warranties, Limitation of Liability, and Indemnification

The following section is in capital letters to make sure it stands out. Please read it carefully.

YOUR USE OF THE SERVICE AND ALL MATERIALS IS SOLELY AT YOUR OWN RISK. THE SERVICE AND ALL OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IT PROVIDES IS CORRECT OR SUITABLE FOR YOUR PET'S CIRCUMSTANCES.

TO THE FULLEST EXTENT PERMITTED BY LAW, GENO BROWN AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY INJURY TO, ILLNESS OF, OR LOSS OF A PET, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE AND USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU. OUR SERVICE PROVIDERS ARE INTENDED THIRD-PARTY BENEFICIARIES OF THIS SECTION.

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS GENO BROWN AND ITS OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS, DAMAGES, LOSSES, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, YOUR INPUTS, YOUR BREACH OF THESE TERMS, OR YOUR VIOLATION OF ANY LAW OR THIRD-PARTY RIGHT.

XII. Term and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at our discretion, including if you violate these Terms or if we must do so to comply with law. We may also delete Materials associated with your account following termination. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

XIII. Changes to the Service and These Terms

The Service is new and will change; we may add, modify, or remove features, or suspend or discontinue the Service, at any time. We may also revise these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, provide notice through the Service or by other reasonable means. If you continue to use the Service after the updated Terms take effect, you agree to them. If you do not accept the updated Terms, you must stop using the Service.

XIV. General Terms

Entire agreement. These Terms, together with any terms incorporated by reference, are the entire agreement between you and us regarding the Service. Severability. If any provision is held unenforceable, the remaining provisions remain in effect. No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later. No assignment. You may not assign these Terms without our consent; we may assign them without restriction. Use of our brand. You may not use our name, logo, or trademarks without our prior written permission. Export and legal compliance. You may not use the Service in violation of applicable export-control or sanctions laws, and you represent that you are not located in an embargoed region or on a restricted-party list. We may comply with lawful governmental, court, and law-enforcement requests relating to the Service.

XV. Disputes

Equitable relief. You agree that a breach of Section III (Use of the Service) may cause irreparable harm for which monetary damages would be inadequate, and that we may seek injunctive relief without the need to post a bond.

Governing law and jurisdiction. These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.
